London, 11 November 2016: In an attempt to bring down the immigration figure, the Theresa May led government in UK has announced modifications to the visa policy for non-EU nationals. The move will, among others, impact a big number of Indians particularly IT professionals in India.
As per the new visa rules, anyone who applies under the Tier 2 intra-company transfer (ICT) visa category after 24th November 2016 will have to meet a higher salary threshold requirement of £30,000 from the previous £20,800.
It’s chiefly the Indian IT companies that use the ICT route in the UK and the Migration Advisory Committee (MAC) had found earlier this year that Indian IT workers had got almost 90% of the visas issued through this option.
The changes were decided upon and announced just 3 days before British PM Theresa May went to India on a 3-days visit. In addition to the Tier 2 ICT salary threshold increase, there were some more changes announced. These are to increase the Tier 2 (General) salary threshold for experienced workers to £25,000, with some exemptions; reduce the Tier 2 (ICT) graduate trainee salary threshold to £23,000 and raise the number of places to 20 per company per year. Closing the Tier 2 (ICT) skills transfer sub-category is another update.
Some changes have also been declared on the Tier 4 category that covers maintenance requirements for the Doctorate Extension Scheme. The non-EU residents in the UK, including Indians will further be impacted by the new English language requirements while applying for settlement as a family member after 2.5 years in the UK on a 5 years route to residency settlement in the country. The new law will apply to partners and parents whose current leave to remain in the UK under the family immigration rules is due to expire on or after May 1, 2017.
