The Scotch Whisky Association (SWA) is the trade association for the Scotch Whisky industry. One of its principal aims is to safeguard the Scotch Whisky trade worldwide. This function is carried out by the SWA Legal Affairs Department, which takes legal action around the world to prevent products being misleadingly sold as Scotch Whisky. It also monitors trade mark applications internationally and opposes those that may be used in a similar misleading manner. The legal department consists of a director and three other experienced intellectual property lawyers, a paralegal and two support staff.
The position involves a diverse range of work, including the investigation of suspicious products, the preparation of court and administrative actions worldwide, the review of trade mark applications worldwide, drafting and revising a range of legal documents, negotiating agreements and advising the SWA’s members on compliance.
Candidates should be qualified solicitors or advocates/barristers preferably with at least 2 years’ civil litigation experience. Knowledge of intellectual property law would be helpful but is not essential. Excellent negotiating and communication skills, attention to detail, an ability to work in a collaborative manner and strong IT skills are required.
